This website is operated by MythCove ("MythCove", "we", "us", "our"). Throughout the site, these terms refer to MythCove. MythCove offers this website, including all information, tools and services available from it, to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting mythcove.com or purchasing from us, you engage in our "Service" and agree to be bound by these Terms of Service, including the additional terms and policies referenced here and available by hyperlink. These Terms apply to all users of the site, including browsers, customers, merchants and contributors of content.

If you do not agree to all the terms of this agreement, you may not access the website or use any Service.

1. Online store terms

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given your consent to allow any minor dependant to use this site. You may not use our products for any illegal or unauthorised purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction, including copyright laws. A breach or violation of any of these Terms will result in immediate termination of your Services.

2. Products and descriptions

We make every effort to display the colours and images of our products as accurately as possible. We cannot guarantee that your display will show colours accurately, and photographs supplied by manufacturers are taken under studio lighting. Variation in colour, paint application, blushing, seam lines and assembly is normal on hand-finished collectibles and is not a defect.

Blind boxes and sealed random-assortment items contain a design determined by the manufacturer’s random packing. We cannot select, identify in advance, or guarantee any particular design, and receiving a design you did not want is not a defect.

All products sold by MythCove are sourced from the studios, brands and authorised distributors behind each series. Most items are intended for adult collectors and are not toys; they may contain small parts and fragile components. Manufacturer age guidance, where provided, appears on the product page.

We reserve the right to limit the quantities of any products we offer, to discontinue any product at any time, and to refuse any order placed with us. Product availability and prices are subject to change without notice.

3. Pricing, payment and errors

All prices are shown in US dollars (USD). Where your card is issued in another currency, conversion and the applicable rate are determined by your bank.

Occasionally there may be information on our site containing typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times and availability. We reserve the right to correct any such error and to change or update information, or cancel an affected order, at any time without prior notice, including after an order has been submitted. Where an order is cancelled for this reason, you receive a full refund.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store.

4. Shipping, delivery and import charges

Shipping, dispatch times and delivery are governed by our Shipping Policy. Delivery estimates are provided by carriers and are not guarantees. Risk in the goods passes to you on delivery by the carrier to the address you supply.

Unless expressly collected at checkout, import duty, VAT, GST and carrier handling fees are payable by you as importer of record.

5. Returns and refunds

Returns, cancellations and refunds are governed by our Refund Policy, which forms part of these Terms. Nothing in these Terms limits any right you have under the consumer law of your own country.

6. Accuracy and completeness of information

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions. This site may contain historical information which is not current and is provided for reference only. We are under no obligation to update any material on the site.

7. Third-party links

Certain content and services available via our Service may include materials from third parties, and third-party links on this site may direct you to websites not affiliated with us. We are not responsible for examining or evaluating their content or accuracy, and we do not warrant or assume liability for any third-party materials or websites. Complaints, claims or questions regarding third-party products should be directed to the third party.

8. User comments and submissions

If you send us creative ideas, suggestions, proposals, plans, reviews or other materials, whether at our request or otherwise, you agree that we may at any time and without restriction edit, copy, publish, distribute, translate and otherwise use them in any medium, without obligation to pay compensation or to maintain them in confidence. You agree that your comments will not violate any right of any third party, will not contain unlawful, abusive or obscene material, and will not contain any computer virus or malware. We may, but have no obligation to, monitor, edit or remove content we determine to be unlawful, offensive or otherwise objectionable.

9. Personal information

Your submission of personal information through the store is governed by our Privacy Policy.

10. Prohibited uses

In addition to other prohibitions set out in these Terms, you are prohibited from using the site or its content for any unlawful purpose; to solicit others to perform unlawful acts; to violate any regulations, rules or laws; to infringe upon our intellectual property rights or those of others; to harass, abuse, defame or discriminate; to submit false or misleading information; to upload or transmit viruses or any code that will affect the functionality of the Service; to collect or track the personal information of others; to spam, phish, pretext, crawl or scrape; for any obscene or immoral purpose; or to interfere with or circumvent the security features of the Service. We reserve the right to terminate your use of the Service for violating any of these prohibited uses.

11. Disclaimer of warranties; limitation of liability

We do not guarantee that your use of our Service will be uninterrupted, timely, secure or error-free. You agree that from time to time we may remove the Service for indefinite periods or cancel it at any time, without notice to you. Except as expressly stated by us, the Service and all products delivered to you through it are provided "as is" and "as available" for your use, without any representation, warranty or condition of any kind, express or implied, except those that cannot be excluded under applicable law.

To the maximum extent permitted by law, MythCove and its directors, officers, employees and suppliers shall not be liable for any indirect, incidental, punitive, special or consequential loss, or for any loss of profit, revenue, data or goodwill, arising from your use of the Service or of any product procured through it. Where liability cannot be excluded, our total liability is limited to the amount you paid for the order concerned. Nothing in these Terms excludes liability for fraud, for death or personal injury caused by negligence, or for any other liability that cannot lawfully be excluded.

12. Indemnification

You agree to indemnify, defend and hold harmless MythCove and our affiliates, officers, employees and suppliers from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

13. Severability

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed without affecting the validity of the remaining provisions.

14. Termination

The obligations and liabilities incurred by the parties prior to termination survive termination of this agreement for all purposes. These Terms are effective unless and until terminated by either you or us. You may terminate them at any time by ceasing to use our site. If in our sole judgement you fail to comply with any term of these Terms, we may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination.

15. Entire agreement

These Terms, together with any policies posted by us on this site, constitute the entire agreement between you and us and govern your use of the Service, superseding any prior agreements or communications. Any failure by us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Ambiguities are not to be construed against the drafting party.

16. Governing law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong shall have non-exclusive jurisdiction. This does not deprive you of the protection of the mandatory consumer law of your country of residence.
